Dozens of cats rescued in house fire
Dozens of cats were rescued
from a house fire on Vine Street in Daytona Beach on October 6, 2009.
Vehicle one motorcyclist was traveling westbound on Beville Road from Clyde
Morris Blvd. Driver of vehicle two was traveling eastbound on Beviile Road .
Vehicle two driver was attempted to make a left turn onto Forest Lake.
Vehicle one impacted vehicle two on the passenger side, driver of vehicle
one was ejected from the motorcycle and had extensive head trauma and was
pronounced dead at Halifax Medical Center at 1124 hours. Motorcyclist
identification is being withheld pending next of kin notification he is 21

UPDATE: Oct. 5, 2009 at 1103 am
As of this time, the investigation has revealed that this incident appears
to be related to narcotics and involved one of the suspects confronting
Lindsay at the front door. A struggle ensued resulting in Lindsay being
shot inside of the apartment, subsequently resulting in his death. A
resident of the apartment then confronted the suspect. As the resident was
defending the lives of the persons inside of the apartment, the suspect was
fatally wounded. Detectives investigating this incident conferred with
members of the State Attorney’s Office and it was agreed that the resident’s
actions were justified as a result of the suspect’s actions. The name of
the suspect is being withheld pending next of kin notification. The name of
the resident is also being withheld at this time due to the nature of this
investigation and information that is still being sought. No arrests have
been made as of this date.

On the above date and time, patrol units responded to the above location in
regards to shots fired, upon arrival one male was dead(gunshot) at the scene
and one male was transported to Halifax Medical Center, shortly thereafter
the male at the hospital died from his gunshot wound.This appears to be a
Home Invasion. All of the shots were fired inside the apartment and the
initial investigation revealed that the male who died at the scene was one
of the suspects (unknown how many at this time) doing the Home Invasion and
the male who died at the hospital was visiting the residence. Detectives
are interviewing the renter of the apartment who was inside of the apartment
during the shooting. The male who died at the hospital is identified as
Merton Oliver Lindsay B/M 01-16-82; the male at the scene who died has not
been positively ID. The investigation is ongoing and it’s is unknown who did
the shooting at this time.

Re: Dealing In Stolen Property

The Daytona Beach Criminal Investigation Division began been an
investigation at the above location in regards to employees at the business
buying and receiving stolen property. The source advised that he was able to
sell golf clubs and other sporting goods equipment to an employee name Tim
Bail. On September 30, 2009 the source entered the business and advised the
employees he had items for sale (golf equipment) and that they were stolen
the unknown male asked to see the putter. The source retrieved the putter
from his vehicle and returned to the store after seeing the putter the
source was told to come back tomorrow. On October 1, 2009 the source
returned to the business with a putter (Titleist) and two boxes Callaway ix
golf balls. The source told Bail that the items were stolen and that he
wanted to sell them, Bail and the source began discussing other items (golf
equipment) that the source advised he had. Bail agreed to buy the putter,
the driver and the set of iron only if the source came back with all the
items at once. The source returned to the store with golf equipment valued
at approximately $1900.00. Bail advised that he would not do the deal at the
business and instructed the source to drive over to Walgreens parking lot to
do the deal. The source gave Bail the driver, putter and set of irons total
value $1700.00, the source was given $105.00. Bail placed the items in his
vehicle and drove back to the business which is in the same parking lot as
Walgreens. A search was obtained for the business and Bail’s vehicle.
Several items were recovered during the search warrant. Arrested and charged
with Dealing in Stolen Property were Timothy Bail W/m DOB 05/30/73 777

Re: Attempted Armed Robbery

Units responded to the above location in regards to an attempted armed
robbery that had just occurred. Upon officer’s arrival, they learned that a
black male entered the store wearing a hoodie over his head and a brown
bandana covering his face. The clerk, Thomas Piepenburg, was standing behind
the counter at the time. He told the suspect that he would have to remove
his bandana in order to "do business." This is when the suspect ordered
Piepenburg to give him all of the money. Piepenburg initially thought that
the suspect was joking and told him again to remove the bandana. This is
when the suspect slide a kitchen knife from one of the sleeves of his hoodie
and again ordered the money in the register be given to him. At this point,
Piepenburg stepped back from the counter while stating, "You're not getting
anything." The suspect looked over the counter at the register. When he
realized that he could not reach it from where he was, the suspect left the
store. Piepenburg watched as the suspect walked to the west side of the
building and followed him out. Piepenburg advised that the suspect left in a
silver vehicle, which he believed to be a newer model Mitsubishi Eclipse
with a hatchback. This vehicle might have some damage on the rear from being
backed into the store's dumpster (located on the south side of the
building). It was last observed driving south on Clyde Morris.

On September 24,2009, at approximately 0452 hours victim was operating her
vehicle and was traveling south on Nova Road from George Engram, at the
intersection of Nova Road and I.S.B. she noticed a vehicle following her. As
the victim traveled westbound on I.S.B. the other vehicle continued to
follow. The vehicle pulled up next to the victim’s vehicle several times as
they traveled west on I.S.B. As the victim vehicle approached Hagan Terrace
and I.S.B they heard several gunshots and the rear window was shattered. No
injuries to the driver or passenger. The victim’s vehicle was struck twice.
Kamari Mott has been identified as the driver of the suspected vehicle.
Warrants were obtained (09/24/2009) charging Mott with Principal to
Aggravated Assault and Principal to Shooting into Occupied Vehicle. Bond
$15,000 each. Mott turned himself in on September 25, 2009. Victim Driver

On 09-18-09 at
approximately 1244 hours an elderly female victim was the target of a
wallet thief at the Publix Supermarket at 1500 Beville Road. The thief,
described below, walked into the store and took up a shopping cart as if
she was a customer. Within one to one and one-half minutes the thief took
the victims wallet surreptitiously and left the store immediately
thereafter.

Black Female, age undetermined, but possibly in her late 30’s to 40’s.
She is approximately 5’7” to 5’9” with a thin build. As can be seen in
the photo she was wearing a light colored skirt with flower prints and a
maroon or burgundy top. The suspect did have jewelry and a large grey
“floppy” purse. Her vehicle, if any, is unknown.

custody at a home in Deland Florida (442 South Hill Street) at
approximately 1800 hours today (09-15-2009). Ward was wanted on Murder
charges in the death of thirteen year old Lloyd Robinson Jr. back in July

Re: Lewd or Lascivious Exhibition

On 08/22/09 at approximately 18:18 hours, officers responded to the above
location in regards to the aforementioned offense. Investigation revealed
that a 13-year-old male entered the bathroom at Sears, located at the
Volusia Mall, on the second floor. The victim went into a stall and was then
offered toilet paper by a subject in the next stall (who was already inside
prior to the victim entering the bathroom). The suspect began sliding
toilet paper through the cracks in the stall, even after the victim declined
needing it. The suspect proceeded to proffer a lewd question toward the
victim and the victim replied in a negative response. When the victim
exited the bathroom stall, the suspect (who was standing near the urinal)
made a lewd comment and exposed himself to the victim. The victim was then
able to run out of the bathroom. The report and

After review
of the video by police personnel, it is believed that a minor child
(appeared to be younger than 12) as well as several other persons entered
and exited the bathroom during the time the suspect was present inside of
the bathroom. The Daytona Beach Police Department is asking that anyone who
may have observed any suspicious activity inside of this bathroom on 8/22/09
between 3:45 p.m. and 4:15 p.m. call the Department immediately. We are
also asking that the parents of any children that entered into this bathroom
during this time call the Daytona Beach Police Department immediately if the
child is reporting suspicious activity as well.
Update (09-17-09)
Detectives
in Illinois interview the victim and showed him a photo-line-up and without
hesitation he positively ID Claude Richard Smith W/M DOB 05-01-44 as the
person who committed the lewd act. At approximately 1830 hours today Smith
was arrested at 1780 Twin Oaks Drive in Deland Fl. And charged with Lewd or
Lascivious Exhibition. He was transported to the Branch Jail with a bond of
$2500.00. No other victims have came forward.

Missing Endangered
On 09/17/2009 at 1254 hours, patrol responded to 1035 Cadillac Drive in
regards to a missing person. The reporting party states that her brother is
visiting her from Jacksonville Fl. On today’s date at 0830 hours M-1 Edgar
Borders left the residence to go for a walk and did not return, he normally
takes walk on a usual basis but they do not exceed thirty minutes. The
reporting party looked for Borders for several hours with negative results.
Borders suffer from Dementia. Borders is described as a B/M 5-6 160 lbs
clean shaven and was wearing white jeans shorts and a blue plaid shirt he is
61 year old. Anyone with information is asked to call the Daytona Beach

ROBBERY – 441 SEABREEZE BLVD.
On 9-17-09 at approximately12:04 pm, an elderly black male suspect entered
the Wachovia Bank located at 441 Seabreeze Blvd. and demanded money from the
teller. The teller handed over an undetermined amount of money and the
suspect left the bank, last seen headed east bound on foot. The suspect is
described as a black male, dark skinned, 50-60 yoa, approx. 5’2” - 5’4”,
very thin build, short hair (unknown color), wrinkly hands and face,
wearing a light blue Polo style shirt with a dark blue t-shirt underneath,
dark blue long pants, brushed silver ring on unknown hand, dark shoes and a
white “pith” helmet (electrical worker style). See

Armed Robbery – Bermuda House
On Thursday, September 17, 2009
at approximately 0625 hours a white male suspect entered the lobby of The
Bermuda House at 2560 North Atlantic Avenue. The victim was in the back
office of the front desk with the only entry door to this area being locked.
The suspect utilized a chair from the pool area to jump over the front desk
counter and made his way back to the back office. The suspect pointed a
small to medium sized semi – auto handgun, black in color at the victim and
made threats to do harm while demanding money. The victim complied by giving
the suspect an undetermined amount of money. The suspect ordered the victim
to the ground and fled in an unknown direction. The suspect was very
apologetic (I’m sorry) the suspects are described as follows:

On Monday, September 14, 2009, at approximately
2118 hours, the suspect approached the victims in the parking lot of the CVS
store. The suspect displayed a handgun and pointed it at the victims. The
suspect demanded the victims give him their wallets and mobile phones. The
victims gave their items to the suspect. The suspect fled on foot. Witnesses
observed the suspect enter a taxi cab near the Greyhound Bus Station.
Officer L. Jones came in contact with the taxi driver who stated that he had
just dropped the suspect off at the intersection of S. Martin Luther King
Jr. Boulevard and Eldorado Street. Units checked the area. A witness stated
that the suspect entered a residence at 634 Eldorado Street. The suspect was
apprehended in the residence. The victims and witnesses were able to
identify the suspect. A search of the residence revealed the handgun, a ski
mask, and items that were stolen from the victims. The victim's mobile
phones were recovered on S. Segrave Street during an article search by
Officer M. Oteri and his Canine partner. Johnson, who was wanted for an
armed robbery that occurred on September 4, 2009, was observed hiding in the
closet at 634 Eldorado Street. (A-2) Johnson was apprehended.
