Health Care Legislation
As discussed at the Post Conference Board
meeting and reiterated in our Grassroots
Report of 10/9/09 and on our web site, I
have been apprehensive about the potential for
the inclusion of provisions in Health
Care legislation which would be detrimental to the
interests of our membership.
The legislation reported out of the
Senate Finance Committee includes language
providing for an excise tax on health
care plans which cost in excess of a prescribed
amount, as outlined in the attached fact
sheet prepared by the National Legislative Office.
There is no doubt that this tax would be
passed on to plan participants. Many other labor
organizations share these concerns.
Therefore, I have directed the National
Legislative Office to make our opposition to
taxation of benefits, whether direct or
indirect, known to both Houses of Congress and
the White House. We will work with other
groups to eliminate this provision.
The attached fact sheet is current as of
today. As you know, the legislative process is
very fluid and change can come rapidly at
times. We will keep you advised as changes
occur during consideration of the
legislation.
Fact Sheet: Excise Tax on Insurance
Premiums in the Health Reform Bill
• The bill that passed out of the Senate
Committee on Finance yesterday includes an excise tax
of 40% on insurance companies and plan
administrators for any employer-sponsored health
coverage with premium above an $8,000
threshold for individuals and a $21,000 threshold
for family plans beginning in 2013. In the
case of a self-insured group, the excise tax would
be paid by the plan administrator (the law
enforcement agency or local government).
a The total of the premium includes
employee and employer contributions for health,
dental, vision, and other health related
plans.
a The threshold is indexed to the Consumer
Price Index for Urban Consumers, as
determined by the Department of Labor
beginning in 2014, plus one percent (CPI+1).
• The threshold amount for plans that cover
employees engaged in high risk professions,
including law enforcement, is increased by
$1,850 for individual coverage and $5,000 for
family coverage.
a Beginning in 2013 the threshold for law
enforcement officers would be $9,850 for an
individual and $26,000 for families. (The
threshold is also increased similarly for
retirees, but there is no double dipping.)
• While most plans for law enforcement
officers currently have premiums below the threshold
levels, the CPI+1 index are well below the
inflation rate of Health Premiums in recent years.
Estimates by the Joint Committee on
Taxation have more than a quarter of all family and
individual healthcare plans by 2015 falling
under the tax. This rate is expected to be higher
for law enforcement officers.
• Even though the proposed excise tax is
levied on the insurance companies and plan
administrators it will have a negative
impact on law enforcement officers. The cost is
likely to be passed on to our members in
increased premiums, less coverage, or a
combination of both.
a For example, an individual plans that
costs $10,850 would be taxed $400. The
insurance companies or plan
administrators would most likely increase
premiums by over $500 or offer $400 less
coverage to cover the tax.
a As currently, written this tax is
applied to self-insured State and local
governments and insurers providing
coverage for them.
• Other labor and public safety
organizations that are opposed to the Excise tax include: the
International Association of Fire Fighters,
the National Education Association, American
Federation of State, County and Municipal
Employees, United Mine Workers of
America,
American Federation of Teachers, and
AFL-CIO.
• This proposed tax may fail, however we
must prepare for other funding source proposals
coming out of Congress, which could be
equally troubling such as an increase in the income
tax or ending the tax exemption on employer
provided health benefits. Other proposals
include a tax on insurance company profits.

Stimulus Still Not Working, Yet House Dems Want to Gamble on More
Taxpayer Money
Will Suzanne Kosmas Support Pelosi’s Second Stimulus?
Washington-
With 15.1 million people out of work, a 9.8% unemployment rate,
and a bloated federal deficit it is evident that the Democrats’
trillion dollar stimulus isn’t working. But despite these
alarming numbers, House Democrats are willing to gamble on a
second stimulus offering more ways to tax, spend and borrow. With
a government-takeover of healthcare looming and a National Energy
Tax pending, another stimulus would prove even more detrimental
to taxpayers. After supporting the first failed stimulus, will
Suzanne Kosmas gamble with more Florida taxpayer money?
“Suzanne Kosmas had the option to vote for a Republican version
which would have created more jobs at a faster pace with a lower
cost, but instead proved to be reckless with Florida taxpayer
money by voting for Nancy Pelosi’s failed stimulus,” said NRCC
Communications Director Ken Spain. “Now, having led the nation
into heaps of debt and the biggest federal deficit in history,
Kosmas and her party are intent on spending
billions of taxpayer dollars on frivolous expenditures while
middle-class families in Florida are suffering.
With that kind of record of fiscal irresponsibility, can Florida
taxpayers really trust another Democrat stimulus?”
Democrats asked the “American people to trust them with an
unprecedented level of funding
to address the economic emergency.” But their promises
have fallen flat as 7.2 million jobs have been eliminated since
the recession began.

the American people to trust their government with an
unprecedented level of funding to address the economic emergency.
In return, we must prove to them that their dollars are being
invested in initiatives and strategies that make a difference in

With all signs pointing to a jobless recovery despite passing a
trillion dollar stimulus plan, is it really a good idea for
Suzanne Kosmas to ask Florida families to open their check books
to fund a second Democrat stimulus?

voted on them, according to House Minority Leader John Boehner, who plans

hours of being adopted.

horrific. Shame on our government for not monitoring and strictly
enforcing stringent laws regarding slaughtering and processing meats. Do
we have to have a total collapse such as we had with the banks and
financial institutions for our government and agencies to make a firm
stand and commitment to safe foods?

Suzanne Kosmas: Corruption? What Corruption?
Kosmas Blocks Measure Asking Tax-Cheating Dem Chairman to Step Down
Washington-
With corruption running rampant through the ranks of the Democrat
party as unemployment and deficits continue to rise, Suzanne Kosmas
looked the other way today when she sided with Ways and Means
Committee Chairman Charlie Rangel, a powerful New York political
boss who has a long history of playing fast and loose with the law.
Despite Rangel’s well-documented penchant for cheating on his taxes,
failing to disclose income, and breaking House rules, Kosmas sided
with her corrupt colleague when she voted to block consideration of
a resolution on the House floor requiring Rangel to step down from
his powerful committee chairmanship until the House Ethics Committee
completes its seemingly endless investigation into Rangel’s dirty
deeds (House Roll Call 759).
The vote came as House Speaker Nancy Pelosi continuously refuses to
ask her crooked wingman to step down from his post:
“Why is House Speaker Nancy Pelosi refusing a growing chorus of
calls to drop the hammer on ethics-challenged Charlie Rangel?”
“Because, at the moment, doing nothing creates a lot less trouble
for Pelosi than doing anything, current and former House aides tell
POLITICO.”
“‘The speaker is totally behind him, and she told him that the last

"In this time of great economic uncertainty and mounting deficits,
what kind of message are Suzanne Kosmas and her liberal party
leadership sending when they openly endorse an individual who can't

her friends in Washington or stand with the voters and taxpayers who
have to shoulder the burden of her party’s corruption problem.
Kosmas' decision to back her Washington political boss is a clear

“Representative Charles B. Rangel has earned more than $75,000 in
rental income from a villa he has owned in the Dominican Republic
since 1988, but never reported it on his federal or state tax
returns, according to a lawyer for the congressman and documents
from the resort. Mr. Rangel’s three-bedroom villa at the Punta Cana
Resort and Club in the Dominican Republic. Mr. Rangel, chairman of
the House Ways and Means Committee, which writes the federal tax
code, bought the beachfront villa at the Punta Cana Yacht Club and
has received twice-yearly payments from the resort, which rents the

$250,000, land in southern New Jersey and stock in PepsiCo and fast

“Rep. Charles Rangel, chairman of the tax-writing Ways and Means
Committee, has failed to pay taxes on two plots of land he has in
New Jersey, records show. Rangel's ownership of the small,
undeveloped properties came to light on Tuesday only after he
drastically amended at least six years of financial-disclosure forms
he had filed annually with the House clerk as required by law. The
corrected filings as much as doubled the amount of personal wealth
Rangel has claimed going back years and revealed at least $780,000
in previously unreported assets. The Harlem Democrat concealed
somewhere between $38,902 and $116,800 in 2007 income, according to
the revised filings. Among the assets he failed to list was a
checking account containing somewhere between $250,000 and $500,000.
Also undisclosed for years were two lots he owns in Glassboro, NJ,
about 100 miles from the city. Rangel is delinquent on his taxes on
that property, according to the Gloucester County Clerk's office.”

Meanwhile, Calls For Rangel to Resign Have Come from Far and Wide: “Want
to understand why 2009 has witnessed the eruption of Tea Party and
Town Hall protests of unprecedented intensity? Look no further than
Rep. Charles Rangel, the New York Democrat who is chairman of the
House Ways and Means Committee that writes tax law for the rest of
us... It's not like he's got nowhere to go. There's always that
little rental villa he owns at the Punta Canta Yacht Club in the
Dominican Republic. He forgot to report $75,000 in income he derived
from that asset but I am betting it's looking a lot more attractive

“This recommendation does not come easily, considering the New York
Democrat’s four decades of service in Congress. But Mr. Rangel
himself has felt obliged to request three separate House ethics
inquiries of his behavior. While denying serious improprieties, Mr.
Rangel concedes that he has not lived up to the “higher standard”
expected of members of Congress... Committee posts are not bestowed
by voters. They are partisan privileges granted by leaders in
Congress, and Ms. Pelosi must not cut slack for an ally. If Mr.
Rangel refuses a temporary hiatus from his chairmanship, Ms. Pelosi

grasp of his own finances that he neglects to list half his assets

Why

With the nation facing a 9.8% unemployment rate and the largest deficit seen
since 1945, Florida voters expect the White House and Congress to be
focusing on restoring jobs rather than throwing high-dollar fundraisers to
line campaign coffers for partisan Democrats like Suzanne Kosmas. But
instead, Vice President Joe Biden has been on the campaign trail helping his
“old friends” and filling Kosmas' campaign account.
“All told,
Biden will have hosted at least 48 events in at least 22 states and
Washington between March, when he headlined an event in Little Rock, Ark.,
for Sen. Blanche Lincoln, and Nov. 21, when he speaks at the Iowa Democratic
Party's Jefferson Jackson dinner. He's fundraising for party campaign
committees as well as for individuals at the direction of the White House
and at the request of old friends.”

September Unemployment Reaches New Heights as Florida Families Wonder
“Where Are the Jobs?”
Washington-
With September unemployment numbers now out in the open, one thing is
for sure: unemployment isn’t getting any better at 9.8%. Despite
continued promises by Suzanne Kosmas and her Democrat comrades, the
national unemployment rate continues to climb. This is clear indication
that Nancy Pelosi’s failed ‘stimulus plan,’ which Kosmas supported, is
nothing but a ploy for Democrats to force their tax and spend policies
through Congress and onto the American people.

“After
touting Nancy Pelosi’s failed economic policies, Suzanne Kosmas has led
Florida families into a jobless disarray and heaps of debt,” said NRCC
Communications Director Ken Spain. “Given Kosmas' ongoing support for
her party’s reckless spending agenda, it is painfully clear she is
unable to provide the quality leadership Florida families want. Rather
than making independent decisions, Kosmas has become accustomed to
serving as Nancy Pelosi’s yes-man. At this point it’s clear that Florida
families deserve better.”
With
each new report indicating the Democrats’ stimulus plan as a failure,
it’s unconscionable that Democrats continue to claim it’s
working.

A new poll released today shows that the government healthcare takeover
orchestrated by Suzanne Kosmas' Washington leaders has reached a new low
with the American public, with an overwhelming 56 percent disapproving of
their reckless agenda. With her party’s healthcare plans sinking fast,
will Kosmas again ignore a majority of the American people in order to
maintain her unflinching party loyalty?

“Just 41% of voters nationwide now favor the health care reform proposed
by President Obama and congressional Democrats. That’s down two points
from a week ago and the lowest level of support yet measured.
